1. Introduction

B4UDate, LLC (once formed) ("B4UDate," "we," "us," or "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our website and services (collectively, the "Service").

By using our Service, you consent to the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use our Service.

2. Information We Collect

2.1 Information You Provide to Us

Account Registration and Identity Verification: When you create an account, we collect:

• Full name
• Email address
• Phone number
• Physical address
• Date of birth
• Government-issued photo identification
• Facial biometric data (for identity verification)
• Payment information (processed by third-party payment processors; we do not store complete credit card numbers)

Verification Requests: When you request verification of another person (the "Subject"), you provide:

• Subject's name
• Subject's date of birth
• Subject's address
• Subject's phone number
• Subject's social media profiles or usernames
• Any other information you choose to provide about the Subject

Subject-Provided Information: If a Subject consents to authentication, they provide:

• Government-issued photo identification
• Facial biometric data (for identity verification)
• Any information they choose to verify

2.2 Information Collected Automatically

• Device information (IP address, browser type, operating system)
• Usage data (pages visited, time spent, features used)
• Cookies and similar tracking technologies

2.3 Information from Third-Party Sources

• Public records databases
• Smart safety check services
• Identity verification services
• Facial recognition services
• Social media platforms (publicly available information only)
• Other data aggregation services

2.4 Partner Program

If you join our partner program (affiliates, charities and influencers), we collect:

• Your name, organization name, email address, phone number, address, country, website and social media profiles
• Your payout details: the PayPal email address, Venmo phone number or email address, or Wise email address or Pix key you give us
• Tax information, if you're outside the United States and Puerto Rico: the details on IRS Form W-8BEN (your full legal name, country of citizenship, permanent and mailing addresses, date of birth, tax identification number in your country, a U.S. taxpayer identification number if you have one, and any tax treaty claim), or the Form W-8BEN-E your organization uploads
• A record of your electronic signature on Form W-8BEN: the name you typed, and the date, time, IP address and browser you used
• The referrals, commissions, donations and payments credited to your account

2.5 Investigator Program

If you join our program for private investigators, we collect:

• Your name, company name, email address and website, and the description of your services you give us
• Your password, stored in a form we can't read, and, if you turn on two-factor sign-in, its secret key and recovery codes, which are encrypted
• A record of your agreement to the investigator terms: the version you agreed to, and the date, time and IP address
• The members you add as clients, and whether each case is open or closed
• Your charitable contributions: what you charged each client, the contribution and the payment record. Card payments are handled by Stripe; we never receive your card number

3. How We Use Your Information

• Provide, operate, and maintain our Service
• Process your verification requests
• Verify identities and authenticate users
• Generate verification reports
• Process payments and transactions
• Pay partners, and keep the tax forms U.S. tax rules require for payments to people and organizations outside the United States
• List approved investigators for members, show investigators the reports of the members who give them their access code, and record investigators' charitable contributions
• Communicate with you about your account and our Service
• Send you verification results and account notifications
• Improve and optimize our Service
• Detect, prevent, and address fraud and security issues
• Comply with legal obligations
• Protect the safety of our users and the public

4. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

4.1 Service Providers

We share information with third-party service providers who perform services on our behalf, including:

• Identity verification services
• Smart safety check providers
• Facial recognition technology providers
• Payment processors
• Payout providers that send payments to partners (PayPal, Venmo and Wise)
• Data analysis and research providers
• Cloud hosting and storage providers

4.2 With Subjects

When you request verification of a Subject and choose to contact them for authentication, we share limited information with the Subject, including that a verification has been requested.

4.3 Legal and Safety Purposes

• Comply with legal obligations, court orders, or government requests
• Protect the safety, rights, or property of B4UDate, our users, or the public
• Prevent fraud, security threats, or illegal activity
• Respond to legal process or enforceable governmental requests

We don't share partners' tax forms except where the law requires it, for example if the IRS asks for them

4.4 Business Transfers

If B4UDate is involved in a merger, acquisition, sale of assets, or bankruptcy, your information may be transferred as part of that transaction. We will notify you of any such change and any choices you may have regarding your information.

4.5 With Your Consent

We may share your information with third parties when you have given us explicit consent to do so.

4.6 With Investigators You Choose

Approved investigators' company name, description and website are shown to members on their screening results. When you follow an investigator's link, we record that you did and when, and our administrators can see that record.

If you give a private investigator the third-party access code from your profile, they can see the reports on your matches and download them as PDFs. This includes the details you and your matches gave us (such as name, date and place of birth, address, email address, phone number, previous address and IP address), data validation results, whether a match's government ID check passed, social media search results and any criminal records report. They also see your name and your matches' names and email addresses.

Investigators are independent businesses, not part of B4UDate. They agree to our investigator terms, which require them to keep reports confidential and use them only for your case, but they are responsible for how they handle the information once they have it. An investigator keeps access until they close your case or we deactivate their account; generating a new access code does not end an existing case. To end an investigator's access, contact our support team.

5. Data Retention

• Account information: Retained for as long as your account is active, plus any period required for legal or business purposes after account closure
• Verification reports and Subject data: The data our verification providers return is deleted 7 days after the verification is completed. The results shown to you are kept for 30 days after the verification is completed, then deleted. The details entered about a Subject are kept until you delete that Subject or your account. If you choose to save your own social media profile for future searches, it is kept for 30 days.
• Transaction records: Retained as required by law and for accounting purposes
• Partner tax forms: Retained while you're a partner and for as long afterwards as U.S. tax law requires us to keep them
• Investigator records: If an investigator deletes their account, their profile is deleted; records of their cases and charitable contributions are kept for accounting and legal purposes
• Communications: Retained as necessary for customer service and legal purposes

You may request deletion of your account and associated data at any time by contacting our support team.

6. Data Security

• Encryption of data in transit and at rest
• Secure access controls and authentication
• Regular security assessments and updates
• Employee training on data protection
• Secure data centers and infrastructure
• Partners' dates of birth, tax identification numbers and tax forms are encrypted when stored; only administrators who sign in with two-factor authentication can open them, and every download is recorded

However, no method of transmission over the internet or electronic storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security.

7. Your Privacy Rights

7.1 Access and Correction

You have the right to access and update your personal information through your account settings or by contacting us.

7.2 Deletion

You may request deletion of your personal information, subject to certain legal exceptions.

Investigators can update their details or delete their account from their profile page.

7.3 Opt-Out of Communications

You may opt out of receiving promotional emails by following the unsubscribe instructions in those emails. You cannot opt out of service-related communications.

7.4 State-Specific Rights

For California Residents (CCPA/CPRA):

• Know what personal information we collect, use, disclose, and sell
• Request deletion of your personal information
• Opt out of the sale of your personal information (Note: We do not sell personal information)
• Non-discrimination for exercising your privacy rights

For Virginia, Colorado, Connecticut, and Utah Residents: You may have similar rights to access, correct, delete, and obtain a copy of your personal information.

8. International Users

Our Service is operated from the United States and is intended primarily for users in the United States. If you are accessing our Service from outside the U.S., you consent to the transfer and processing of your data in the U.S.

If you're a partner in Brazil or Colombia, you have the rights that Brazil's General Data Protection Law (LGPD) or Colombia's Law 1581 of 2012 give you, including access to, correction of and deletion of your personal information, except for tax records we must keep by law. We collect partners' tax information to meet U.S. tax rules for payments made outside the United States. To exercise these rights, contact our support team.

9. Children's Privacy

Our Service is not intended for individuals under 18. We do not knowingly collect personal information from children. If we learn that we have collected information from a child, we will delete it.

10. Third-Party Links and Services

Our Service may contain links to third-party websites or services. We are not responsible for their privacy practices and encourage you to review their policies.

11. Cookies and Tracking Technologies

12. Do Not Track Signals
